1. Acceptance of terms

By downloading, installing, or using Gift Whisper, you agree to these Terms of Service. If you do not agree, do not use the app.

2. What Gift Whisper does

Gift Whisper is a mobile app for organizing gift ideas and reminders. Depending on the version, it can help you:

Save people with birthdays or other important dates
Store gift idea notes for those people
Receive reminder notifications before important occasions
Open quick external shopping searches, such as Amazon or Etsy, based on a saved idea

3. Your responsibility as a user

You are responsible for the information you enter into Gift Whisper and for how you use the app.

Make sure the saved dates and names are correct.
Review saved ideas before purchasing a product.
Manage your notification permissions and device settings.
Keep your own device backups if you want to preserve locally stored data.

4. Reminder and purchase disclaimers

Important: Gift Whisper helps you stay organized, but it cannot guarantee that every reminder will be delivered on every device at every time.

Notification delivery can depend on operating system settings, battery restrictions, device permissions, connectivity, and other factors outside our control.

External shopping links are convenience features only. Gift Whisper does not sell products, fulfill orders, or guarantee prices, availability, shipping, or quality on third-party services.

If you use Amazon, Etsy, or another external service, your transaction is directly with that third party.

5. Paid access, if offered

Some releases of Gift Whisper may offer paid access, including yearly or lifetime options. Availability can vary by platform, storefront, or release stage.

Payments are processed by Apple App Store or Google Play, not by us directly.
Subscription status may be managed through RevenueCat.
Yearly plans, if active, may renew automatically unless cancelled in time through your device subscription settings.
Refunds are subject to the policies of the platform that processed your purchase.

If a paid plan is not active in your release, these payment terms simply do not apply to your use of the app.

6. Intellectual property

Gift Whisper, including its branding, design, copy, visual assets, and software, is owned by Rene Arnegger unless otherwise stated. You may use the app for your personal, non-exclusive use in accordance with these terms.

You may not copy, resell, reverse engineer, or redistribute the app except where applicable law explicitly permits it.

7. Limitation of liability

To the maximum extent permitted by law, Gift Whisper is provided on an as-is and as-available basis. We do not guarantee uninterrupted operation, error-free performance, or that the app will always meet your expectations for every device or region.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or exemplary damages arising from your use of the app, including missed reminders, lost local data, or issues related to third-party purchases or websites.

8. Changes and termination

We may update, suspend, or discontinue parts of Gift Whisper at any time. We may also update these terms when the product, pricing, or legal requirements change.
